The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the introduction of a new 28-point plan for achieving ceasefire appeared – briefly – to have been defused. A senior US official spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Moscow made its response: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The chain of contrasting events captured the bleak nature of the recent timeframe. By day, political struggles are conducted: optimistic declarations are issued from different nations. Significant resources is allocated on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "resolution".

After-Dark Attacks

As military strikes developed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is able to track rocket firings from Russian territory, a ability afforded by timely intelligence. From observation points, military aircraft that had been deployed to engage hostile guided weapons roared overhead – advanced fighter aircraft provided to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense engaged: defensive missiles fired to intercept a hostile projectile. This was a advanced protection mechanism at work, probably supplied through Western nations. Every deployment jolts you unexpectedly, causing tremors. The moment of terror quickly gives way to resigned acknowledgment: maybe the incoming missile won't cause damage this time, sparing the city from catastrophe and further power outages.

Persistent Threats

Not long after, a large-caliber weapon fired at a unmanned aircraft somewhere nearby, part of a rapid response unit – most likely imported technology. Sadly, the bullets missed the opposing UAV – it pressed on overhead toward its target.

Intermittently, this carried on until dawn. Kyiv greeted the daybreak reports: multiple fatalities, destruction and utility failures in many homes as a result of the evening attack. As customarily, everyone still continued their routines – living the war. But those 24 hours demonstrated Ukraine's vital need on Western support – a need that neighboring countries are demonstrably unable to substitute in the near term.

Ineffective Peace Efforts

The 28-point plan from Washington generated strong feelings, controversy and profound anxiety – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new proposal from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They manage the tension but never actually achieve victory. This trend will, no doubt, endure.

Strategic Calculations

It is convenient to criticize particular leaders of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. American leadership operates on a assumption well known to seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The American government assumes that it is unfeasible to force Russia to abandon the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, American administration does little to prevent Kremlin actions, through words or deeds, from thinking that the situation will not evolve additionally in its favour in the months ahead.

Conflicting Perspectives

Therefore, the Kremlin is convinced that the clock favors them – that Ukraine and its supporters are approaching exhaustion. Their motivation to accept conditions that does not give them the maximum possible gain is close to zero. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's government remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, progressively conceding lives and land but preventing a total frontline collapse until situations evolve in its advantage.

Current Realities

Realistically, there are no actual prerequisites for a ceasefire. Now, subjective factors are coming into play: leadership ambitions to mediate resolution and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the flag against any initiative Kyiv finds unsuitable, so that their attention does not switch to domestic problems. And although their objective will now be significantly challenging after current events, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Summary and Prospects

It took a mere seven days to kill the proposed articles of the most recent proposal. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with calming attempts of representatives, and finally, current information leaks, all achieved their purpose.

While new proposals based on established approaches are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are rooted in Kremlin requirements and show certain reluctance to modify developments, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, largely rely on ongoing international assistance.
